Access and use of the Australian College of Physician Executives (ACPE) website in general, and the Jobs Board specifically, as found at www.physicianexecutives.com.au (the Website) is governed by the following Terms and Conditions, the Privacy Policy and all notices and disclaimers appearing on the website from time to time (“Terms”). By using the Website you agree to be bound by the Terms.
1. Advertisers
Non-members may apply for a job listing to be advertised on the Website by contacting the ACPE here.
Members may apply for a job listing to be advertised on the Website by completing the relevant section on the Website.
When doing so, you agree to the following terms and conditions as an “Advertiser”:
1.1 Advertisements posted by the Advertiser on the Website are current for a period of 30 days.
1.2 It is the responsibility of the advertisers to ensure that the advertisement complies with the Australian Competition and Consumer Commission (ACCC) guidelines.
1.3 The Advertiser is responsible for proof reading and checking advertisements to be placed. The Advertiser acknowledges and agrees that the ACPE may reject, remove or suspend advertisements at any time should it so wish.
1.4 The Advertiser warrants that the advertisement submitted by the Advertiser for publication and the advertisement as published (in either case, the “Advertisement”):
1.4.1 Is a genuine position as described in the Advertisement and that this is the sole purpose of the Advertisement;
1.4.2 Is not misleading or deceptive to potential candidates or other persons. In particular, the Advertiser warrants that the Advertisement and the Advertiser’s conduct in connection with the Advertisement is not liable to mislead persons seeking the employment as to the availability, nature, terms or conditions of, or any other matter relating to, the employment;
1.4.3 Does not contravene applicable anti-discrimination laws.
1.4.4 Does not contain any material that could reasonably be considered to be defamatory or offensive;
1.5 The Advertiser warrants that it will not use any information obtained from any candidates for the purpose other than the assessment of the persons’ suitability for the role being advertised.
1.6 The Advertiser indemnifies the ACPE from any claim, loss or liability arising (whether directly or indirectly) in connection with the Advertisement or from breach of any warranty given by the Advertiser under the Terms of Use.
1.7 If the ACPE accepts an application to place an advertisement on the Site, the Advertiser grants the ACPE an irrevocable, permanent and royalty free licence to use that advertisement for the express purpose of generating user views and applications.
1.8 The Advertiser agrees to pay a fee for each advertisement successfully filled through the Website, which fee will be based upon a percentage of the total annual remuneration of that particular job listing so advertised, and which fee will be agreed in writing between the Advertiser and the ACPE prior to the advertisement being listed on the Website.
2. Members
Each member searching on the Website as a potential candidate or applying for a position as a result of an Advertisement (a “Candidate”) agrees to the following terms and conditions:
2.1 The member acknowledges that all Advertisements and their contents appearing on the Website are the responsibility of the relevant Advertiser.
2.2 It is the member’s responsibility to satisfy themselves that the advertisement is genuine and that the details he or she provides the advertiser are appropriate to the role advertised.
2.3 The member must take reasonable care in protecting against unauthorised use of their log-on details. The ACPE is not responsible for any unauthorised access to the member’s stored information.
2.4 The member warrants that in responding to any Advertisement or making inquiries of an Advertiser he or she does so as a genuine potential candidate in his or her own personal, non-commercial capacity.
2.5 The member indemnifies the ACPE from any claim, loss or liability arising directly or indirectly from any personal details submitted to an Advertiser.
2.6 The ACPE reserves the right to disable the member’s log-on if he or she is in breach of these Terms.
The following terms and conditions apply generally to advertisers, members and other users or visitors to the Website:
3. Copyright
3.1 All content appearing on the Website is the copyright of the ACPE and is protected by the Copyright Act 1968 (Cth).
3.2 The ACPE logo is a trademark of the Australasian College of Physician Executives Pty Limited and must not be reproduced without permission.
3.3 The ACPE does not provide any advice, representation, endorsement, recommendation or opinion in connection with advertised positions.
3.4 To the full extent permitted by law:
3.4.1 the content appearing on the Website and the services is provided “as is” and without warranties of any kind, whether express or implied;
3.4.2 the ACPE limits its liability to you in connection with its services to either:
3.4.2.1 supplying the relevant Advertisement or service again; or
3.4.2.2 payment of the cost of having the relevant Advertisement or service supplied again;
3.5 The ACPE will not be liable under any circumstances for any loss of profits, indirect, consequential or incidental loss, damage or injury.
4. Liability
4.1 The ACPE does not take responsibility for any of the following:
4.1.1 any interruption to or inability to access any Job Board;
4.1.2 any inability to log-on or access your online account;
4.1.3 any delay or failure in an Advertisement being posted, archived, restored from archive, or taken down or any change to the details or content of such Advertisement being made;
4.1.4 any matter, circumstance or thing beyond the ACPE’s control.
5. Online
5.1 You warrant that in accessing or visiting the Jobs Board or any user account you will not introduce any virus or other malicious harmful or destructive code.
5.2 You are not permitted to link any website to the Website without receiving prior written permission.
5.3 Any advertising appearing on the Website does not imply an endorsement or recommendation of the advertiser or their products or services.
6. Privacy
6.1 The ACPE collects personal information. The collection and use of personal information including cookies is set out in our Privacy Policy, which forms part of the Terms.
7. General
7.1 Nothing in the Terms of Use will exclude, restrict or modify any rights or remedies which you may have under any applicable Commonwealth, State or Territory legislation which under such legislation cannot be excluded, restricted or modified by agreement.
7.2 The ACPE may amend, revise or replace the Terms from time to time.
7.3 These Terms are governed by the laws of the State of New South Wales.
